Spartanburg solicitor has Florence murder re-trial

SPARTANBURG, S.C. (AP) — Spartanburg's top prosecutor is handling the case of a man set to go on trial for a second time for the rape and murder of a Florence woman.

Spokesman Murray Glenn says Solicitor Barry Barnette is handling the re-trial of 54-year-old Robert Lee Nance because of a conflict.

Nance was convicted in 1992 of raping and killing 73-year-old Violet Fraley and attacking her husband. Authorities said Nance forced his way into the Florence couple's home and also stabbed Robert Fraley with a screwdriver.

Robert Fraley has since died. The state Supreme Court on Monday ruled that his original testimony can be read at Nance's new trial.

Glenn and Nance's attorney say no retrial date has been set. Nance is currently being housed at the Lexington County jail.
