Spartanburg magistrate to resign as constable

SPARTANBURG, S.C. (AP) — A state senator says a Spartanburg County magistrate plans to give up his constable’s commission.

Sen. Shane Martin told The Herald-Journal of Spartanburg ( http://bit.ly/JtVUuG) that Keith Allen Sherlin has told him that he will give up his commission as a constable in order to continue serving as a part-time magistrate.

The governor’s office sent Martin and other Spartanburg senators a letter last week asking that Sherlin either resign as magistrate or as constable to avoid potential separation of powers questions.

He has been director of public safety at the South Carolina School for the Deaf and Blind in Spartanburg County since 2002. State law requires police officers on that campus to be constables.

.The school says the director is not required to be a constable.
