Prosecutors Continue to Call Witness’ in Smith Trial

Columbia , S.C. (WOLO) — On Wednesday, state prosecutors continued to call witnesses to the stand in the Michael Juan Smith trial. The state called several witnesses, including investigators and officers who arrived at the scene in the early hours of October 13, 2013. Officer Theodore McLaughlin recalled the early hours of October 13th when he was working foot patrol in Five Points and heard gunshots come from the fountain area. “I saw a man running on the sidewalk, dodging other students or people on the sidewalk,” explained McLaughlin. Officer McLaughlin told the jury he then detained Michael Juan Smith and found a pistol, which he later identified as a Glock 27. He said the firearm was still warm when he retrieved it from Smith‘s jacket pocket. He told the court on the night of the shooting Smith said “I didn’t mean to shoot.” Investigator George Potash was also called to the scene that morning. He told jurors he found blood stains and one shell casing at the scene. “The shell casing was actually laying on the dirt in between the sidewalk and the street,” described Potash. Several other witnesses also testified including some of the people with Smith in Five Points that morning. One witness explained there was an exchange with 2 or 3 other men when they were crossing the street.
