Federal Court Nixes SC Court’s Ruling On Graduation Prayers
The 4th U.S. Circuit Court of Appeals on Tuesday rejected a district judge’s ruling that had upheld prayers at a graduation ceremony for Mountain View Elementary School in Taylors. The Richmond, Virginia-based appellate court sent back to the lower courts to determine if the American Humanist Association members can stop future graduation prayers and also the constitutionality of holding public school events in religious venues.
The association sued in 2013 on behalf of a fifth-grade Mountain View student, arguing the school improperly holds graduation at Baptist-affiliated North Greenville University. The suit says the location of the graduation ceremony violates the First Amendment to the U.S. Constitution.
