Husband of wedding night DUI crash victim seeks deposition in lawsuit against Komoroski

Attorneys for the husband of a woman tragically killed the night of her wedding on Folly Beach in April of 2023 filed a motion Tuesday asking a judge to compel the woman convicted in the DUI crash to submit for a deposition in connection to a civil lawsuit filed against her.

Aric Hutchinson, as a personal representative and also as a representative of the estate of his late wife Samantha Miller (Hutchinson), is suing Jamie Komoroski, who was sentenced to 25 years in prison after pleading guilty in December of 2024 to felony DUI.

In addition to Komoroski, a defendant listed in the suit includes Folly Tacqueria LLC – Taco Boy, an establishment accused of overserving Komoroski alcohol the night of the collision. Some parties included in the original lawsuit settled in June of 2024.

The timeline of the plaintiffs’ attempts to get Komoroski to sit for a deposition are as follows as laid out by Hutchinson’s attorneys:

  • Aug. 23, 2024 – Hutchinson’s counsel served Komoroski’s attorneys electronically scheduling the deposition for Oct. 21, 2024.
  • Aug. 23, 2024 – Komoroski attorney David Cobb responded saying they may have to request a new date. Plaintiffs’ counsel agreed to reschedule if the criminal case wasn’t resolved by date of deposition.
  • Dec. 2, 2024 – The criminal case of Komoroski was resolved by plea deal. Hutchinson’s counsel immediately schedules new date of Jan. 21, 2025 for the deposition.
  • Jan. 3, 2025 – Hutchinson’s counsel reached out to Komoroski attorney Cobb to confirm the deposition noticed served on Dec. 2, 2024. During a phone call between counsels, Cobb said he needed to speak to Komoroski and may need to reschedule.
  • Jan. 10, 2025 – Hutchinson’s counsel follows up again via email. During a phone call, Cobb requested the deposition to be rescheduled.
  • Jan. 13, 2025 – Hutchinson’s counsel attempts to reschedule the deposition. Cobb responds saying he was unaware of where Komoroski was being held. Hutchinson’s counsel provides location of Komoroski and sends the link to her Department of Corrections profile which said she was located at Camille Graham Correctional Center in Columbia.
  • Jan. 17, 2025 – Hutchinson’s counsel tries to reschedule the deposition.
  • Jan. 24, 2025 – Hutchinson’s counsel again tries to reschedule the deposition. Cobb responds saying he was attempting to contact Komoroski’s parents.
  • Feb. 3, 2025 – Hutchinson’s counsel inquires about a new deposition date.

Hutchinson’s attorneys accuse Komoroski’s failure to sit for a deposition of causing delays to the action and have hampered their ability to gain basic information to litigate the case.

The ask the Court to compel Komoroski to respond to discovery as well as the attorney’s fees and costs associated with filing the motion. Hutchinson is represented by Daniel Dalton of Mickelson and Dalton.
