Lawsuit challenges SC Governor’s authority to deploy SC National Guard to D.C.
COLUMBIA, S.C. (WOLO)– A lawsuit has been filed challenging SC Governor Henry McMaster’s authority to deploy the South Carolina National Guard to Washington, D.C.
The lawsuit which was filed by the South Carolina Public Interest Foundation and a navy veteran argues the governor’s deployment violates state law.
Which only allows the guard to be called up under conditions set by the General Assembly.
A spokesman for the governor, Brandon Charochak, responded to the suit saying in part that: “The people of South Carolina have empowered their governors with unambiguous authority to utilize and deploy the state’s national guard… to suggest otherwise demonstrates either a remarkable ignorance of constitutional and statutory law, or a terminal case of Trump derangement syndrome.”
