COLUMBIA SC (WOLO)–With the guilty verdict in the Government’s case against Charleston church shooter Dylann Roof, it now comes down to the federal sentencing.  Roof, who has elected to represent himself in an effort to avoid the death penalty, will make his case to the jury who will ultimately decide if he is placed on death row.  Roof has stated that he will call no witnesses.  He will, however, present opening and closing arguments, as well as have the opportunity to examine the prosecution witnesses, many of which are friends and family of those killed by Roof last year.

Attorney Josh Pozsik from Columbia law firm Pozsik and Carpenter discussed with ABC Columbia’s  Tyler Ryan, his interpretation of the potential outcomes of the federal case, death row, and how it could impact state level sentencing.  Pozsik says that even if Roof were to be giving the death penalty in the federal case, the likelihood he would be executed any time soon is slim, as very few people have been executed by the federal government in the last several decades.  Roof can be, according to Pozsik, be sentenced to death by the State of South Carolina, which uses the death penalty more frequently than the federal government, most recently, 2011.
